This document sets out the terms and conditions which are a legally binding contractual agreement between you (Registered users) and 'TheFreelancerSpace' (TheFreelancerSpace.com). Registered users (referred to as 'members', 'users', 'Employer', 'Buyer', 'Providers') must agree to the following Terms and Conditions. We reserve the right to revise these Terms of Service from time to time in our sole discretion by updating this posting. Unless otherwise provided in such revision, the revised terms will take effect when they are posted.
ELIGIBILITY REQUIREMENTS
To access our Services through TheFreelancerSpace.com, you must be a legal entity, or an individual of eighteen (18) years of age or older who can form legally binding contracts. To become a Registered User, you must accept all of the terms and conditions. TheFreelancerSpace reserves the right, in its sole discretion, to refuse, suspend, or terminate Services to anyone.
REGISTRATION
By registering on TheFreelancerSpace you agree to Terms of Use and conditions of this page and you agree that you have read them. You agree to provide true, accurate and complete information as prompted by the registration form and all forms you access on the website, and to update this information to maintain its truthfulness, accuracy and completeness.
POSTING A PROJECT
The engagement, contracting and management of a project are between an Employer and a Provider. Upon acceptance of a quote, the Employer agrees to purchase, and the Provider agrees to deliver, the services and related deliverables in accordance with the following agreements: (a) the agreement between Employer and Provider including the Project Bid, Project Description, and other terms and conditions as communicated between Employer and Provider on the Website or otherwise, (b) these Terms of Service. Employer is responsible for managing, inspecting, accepting and paying for satisfactory services and deliverables in accordance with the Project Agreement in a timely manner. Provider is responsible for the performance and quality of the services in accordance with the Project Agreement in a timely manner.
PICKING A WINNER FOR A PROJECT
You select one or more Providers, on your project, as winners. You shall discuss the project details and settle on a contract with the Provider, on the project Message Board or via Chat, before you award the project.
PLACING BIDS
When you place a bid on a project, you agree that we will charge you a fee between 0% to 5% of your bid in the moment the employer transfer fund to your account. If you wish not to be selected as a winner, it is up to you to remove your bid from the project.
PAYMENTS
TheFreelancerSpace will make payments/withdrawals if the member requests. All amounts are stated in and all payments will be made in US Dollar.
ESCROW
TheFreelancerSpace provides escrow as a free, bonus, and automated service only as a tool to help members transact more securely. We do not act as an arbitrator between parties, should a dispute arise, except in limited situations. Financial disputes should be resolved between members. We do, however, reserve the right to cancel an escrow payment, at any time, if we believe we are left with no other option. We also reserve the right to complete an escrow payment if no response is received from the payer, after repeated attempts at contact, for 7 continuous days.
DISPUTES
Members may not file a complaint with one of our payment processors, PayPal, regarding the funds deposited into their account. TheFreelancerSpace staff will do its best to resolve any problem a member may have. Due to the incompatible communication systems between our payment processors and TheFreelancerSpace staff members, payment disputes logged directly with those processors cannot be properly managed and will cause further delays. Due to this, members who make a complaint to our payment processor will face account termination without notice. For any dispute use the dispute panel. TheFreelancerSpace reserves the right to make decisions in favor of a party and considers its decision final. Direct transfers and escrow payments fully completed by the buyer are considered final and cannot be considered for reversal.
CONTACT INFORMATION
Members agree not to post their e-mail address, Phone number, ICQ, AIM, MSN Messenger, Yahoo Messenger, Skype, Gtalk, etc on the site, except in the form field on the website where such information is specifically requested. All communication should be done using TheFreelancerSpace Messaging System (Message Board and Chat).
ADVERTISING
You are prohibited from advertising on TheFreelancerSpace.com. Any URL posted in a bid, project description, or the message board, must relate to a project on TheFreelancerSpace.com.
TERMINATION AND SUSPENSION
TheFreelancerSpace reserves the right to terminate or suspend the participation of any member that TheFreelancerSpace judges to be in violation of the Terms and Conditions.
MODIFICATIONS
TheFreelancerSpace reserves the right to change the member Terms and Conditions at any time. It is the member's responsibility to check these Terms and Conditions from time to time for such changes.
